Property Management for NRIs — Without Travelling to Chennai

Many NRIs own property in Chennai — inherited land, apartments purchased before moving abroad, or investment plots. Managing these properties from outside India — whether selling, renting, registering, or applying for approvals — is difficult when you cannot be physically present. A Power of Attorney solves this problem by authorising a trusted person in Chennai to act on your behalf.

However, a Power of Attorney used for property transactions in Chennai must be correctly drafted and properly registered to be legally valid. A POA that does not meet the legal requirements cannot be used for registration or other official purposes, and this is a common problem for NRIs who prepare documents without proper guidance.

At Swathy Associates, we assist NRI clients in the UAE, Saudi Arabia, USA, UK, Singapore, and other countries with drafting and registering Power of Attorney documents for property matters in Ambattur and North Chennai.

What is a Power of Attorney?

A Power of Attorney (POA) is a legal document by which a person (the principal) authorises another person (the agent or attorney holder) to act on their behalf in legal and financial matters. In the context of property in Chennai, a POA allows the agent to buy, sell, register, manage, rent, or carry out other specified acts related to the property — exactly as the principal themselves could do.

For NRI property owners, a POA is not just a convenience — it is often the only practical way to handle property transactions in India without making repeated international trips.

Types of Power of Attorney for NRI Property

General Power of Attorney (GPA)

A General Power of Attorney gives the attorney holder broad authority to manage all property-related matters on behalf of the NRI. This includes selling, purchasing, renting, applying for approvals, managing disputes, and handling documentation. A GPA is appropriate where the NRI wants ongoing, comprehensive management of all their property interests in India.

Special Power of Attorney (SPA)

A Special Power of Attorney is limited to a specific transaction or a specific property — for example, selling a particular flat in Ambattur, or handling the registration of one specific plot. An SPA is preferred for most NRI property sales because it limits the authority of the attorney holder and reduces the risk of misuse.

How the Process Works for NRIs

Step 1 — We Draft the POA

We prepare the Power of Attorney document in the correct legal format required for use in Chennai. The document is drafted based on the specific authority the NRI wants to grant and the specific property or transactions involved. We email the draft to the NRI for review and approval.

Step 2 — Execution at Indian Embassy or Consulate

The NRI takes the POA document to the Indian Embassy or Consulate in their country of residence and signs it before the Consular Officer. The consulate attests the document, which gives it legal standing in India. Some countries require notarisation before consular attestation.

Step 3 — Document Sent to India

The attested POA is sent to the attorney holder in Chennai — typically by courier. We guide NRI clients on the fastest and safest way to send the document to ensure it arrives intact.

Step 4 — Adjudication and Registration in Chennai

After arriving in India, the POA must be adjudicated (stamped) within the required time period. For property transactions, the POA should also be registered at the Sub-Registrar's Office in Chennai. We handle this entire process on behalf of the NRI.

Step 5 — Property Transaction Proceeds

Once the POA is registered, the attorney holder can proceed with the property transaction — whether that is selling the property, registering a sale deed, applying for Patta transfer, or other authorised acts. We coordinate all these subsequent steps as well.

Other Legal Documents We Assist With

Sale Agreement

A legally drafted agreement between buyer and seller, setting out the terms and conditions of the property sale before registration. A well-drafted sale agreement protects both parties if the transaction is delayed or disputed.

Rental Agreement

We draft rental agreements for NRIs who want to rent out their property in Chennai. The agreement can be executed and registered by the attorney holder on behalf of the NRI.

Will Drafting

NRIs who own property in Chennai may wish to document the succession of their assets in a will. We assist with drafting wills that clearly specify the intended beneficiaries of property in India.

Frequently Asked Questions

Can an NRI give a Power of Attorney without travelling to India?
Yes. An NRI can execute a Power of Attorney at the Indian Embassy or Consulate in their country of residence. The POA is then sent to India where it must be adjudicated and registered before use. We guide NRI clients through the exact format required and the steps to follow after the document arrives in India.
What is the difference between a General Power of Attorney and a Special Power of Attorney?
A General Power of Attorney (GPA) authorises the holder to carry out a broad range of acts on behalf of the principal — including managing, renting, selling, and dealing with property in general. A Special Power of Attorney (SPA) is limited to a specific transaction or a specific purpose, such as selling one particular property. For most NRI property transactions in Chennai, an SPA is preferred as it limits the scope of authority.
Does a Power of Attorney need to be registered in Chennai?
For a POA executed abroad by an NRI to be used in a property transaction in Chennai — such as registering a sale deed — it must be adjudicated (stamped) and in most cases registered at the Sub-Registrar's Office in Chennai. A non-registered POA cannot be used for property registration. We handle the registration process after the document arrives from abroad.
Can the POA holder sell my property in Chennai on my behalf?
Yes, if the Power of Attorney specifically grants that authority. The POA must be properly executed, adjudicated, and registered to be used for a property sale. The sale deed will be executed by the POA holder in their capacity as the authorised representative of the NRI owner. Banks and buyers will require the POA to be valid and registered.
What happens if an NRI needs to revoke a Power of Attorney?
A Power of Attorney can be revoked by the principal (the NRI) at any time, as long as no irrevocable act has been performed under it. The revocation must be communicated to the POA holder and, if the original POA was registered, a deed of revocation should also be registered. We assist NRI clients with POA revocation when required.
