A legal opinion is the step that professional buyers and banks insist on before any money changes hands. It is a formal written assessment of a property's title, encumbrance status, ownership history, and legal standing — prepared after reviewing the relevant documents and government records. What is a Property Legal Opinion?
A property legal opinion is a written document prepared by a qualified professional after examining the available title deeds, encumbrance certificate, revenue records, survey documents, and any other relevant papers for a given property. It states whether the title is clear, marketable, and free from encumbrances — or identifies what problems exist and what steps may be needed to resolve them.
Banks in India require a legal opinion before sanctioning a home loan. Many experienced property buyers request one as a matter of practice before signing a sale agreement. If you are buying a property in Chennai, a legal opinion is the single most important step you can take to protect yourself.

What We Examine
30-Year Title Trace
We trace the ownership history of the property back at least 30 years. This means reading through every sale deed, gift deed, partition deed, and court order that forms part of the chain of title. We check that each transfer was made by the right person, with proper authority, and without gaps or breaks in the chain.
Encumbrance Certificate
The Encumbrance Certificate (EC) is an official document issued by the Sub-Registrar's Office that records all transactions and charges registered against a property. We examine the EC to identify any mortgages, loans, liens, or other encumbrances that the seller may not have disclosed. An EC that shows a bank mortgage means the property cannot be freely sold until the loan is discharged.
Patta and Revenue Records
We verify the Patta — the official land record that identifies the lawful possessor of the land. We check that the Patta is in the name of the person selling the property, and that there are no discrepancies in the survey number, extent, or boundary details. We also check the A-Register extract and other revenue records where applicable.
Litigation Check
We examine whether there are any known disputes or legal proceedings involving the property — including family partition suits, court attachments, stay orders, or government acquisition notices. A property under active litigation cannot be safely purchased until the dispute is resolved.
Layout and Approval Status
For plots, we verify whether the layout has been approved by CMDA, DTCP, or Panchayat authorities. An unapproved layout can create serious problems when applying for building plan approval, bank loans, or future resale. We check the approval status as part of the legal opinion process.
Boundary and Survey Consistency
We compare the boundaries described in the sale deed with available survey records, the FMB sketch, and the physical boundaries of the property as described. Discrepancies in boundaries can indicate encroachments, incorrect measurements, or documentation errors that need to be resolved before purchase.
What You Receive
After completing our review, we provide you with a written legal opinion clearly stating our findings. The opinion covers the title status, encumbrance position, revenue records status, layout approval, and any issues identified. If the title is clear, we say so in writing.
